WSIAT Expands the Scope of Entitlement for Traumatic Mental Stress

The Workplace Safety and Insurance Appeals Tribunal (“WSIAT”) recently released a decision that significantly expands the scope of entitlement for workplace events that cause traumatic mental stress.  In Decision 483/11, the WSIAT broke from prior jurisprudence and held that workers can receive benefits for traumatic mental stress following events that do not present a real or implied threat to a person’s physical well being.  In Decision 483/11, the WSIAT awarded traumatic mental stress benefits to an educational assistant after she was falsely accused of striking a student in class.
